Your access to and usage of Trade Your Container FZ LLC container trading and leasing platform (the TYC) are governed by these Terms of usage . You acknowledge and agree to follow these Terms by accessing or using the Platform. Please do not access or use the Platform if you do not agree to these Terms.
Agreement to the Terms
You assure that you are an authenticated NVOCC/VOCC or a Shipping company and that you have agreed to these terms of usage. By agreeing to these terms, you also promise to abide by all the applicable laws and regulations.
Signing up
In order to utilize specific features of the Platform, you might need to register for an account. During the registration process, you pledge to give accurate, comprehensive, and up-to-date information, and to maintain such information updated. You are in charge of all activity that take place under your account and of keeping your login information secret.
Utilizing the Platform
By using the Platform, you consent to abide by these Terms as well as any applicable laws or regulations.
You must not:
- Make any unauthorized or illegal use of the Platform.
- Send any malicious code, malware, or other materials that could impede, damage, or interfere with the Platform or other user’s devices ability to operate.
- Make an effort to access the Platform or any other user’s account without authorization.
- Harass, threaten, or assume the identity of another user on the Platform.
- Violate the rights that are belonging to the Company or third party’s intellectual property rights.
- Take part in any dishonest or false activity on the platform.
Payment Handling
Please take proper notice, that it is important for the payment to reflect in the TYC account first, and then TYC will send the release within at least 48 to 72 hours to the respected party.
No release will be issued without payment reflecting in the TYC bank account.
Both parties should strictly agree to these terms before considering TYC as a payment handling in between.
Deal Cancellation
A penalty of $100 will be charged on cancellation of any deal. If payment has been received or container release has been sent, then payment will not be refunded. In the worst-case scenario, a penalty of $200 will be incurred on the container..
Material
You might be able to upload, submit, store, or send content (text, photos, and other materials, among other things) through the Platform. Although the Company is granted a non-exclusive, global, royalty-free license to use, display, and distribute your content in connection with the Platform’s operation and promotion, you maintain ownership of your content.
Secrecy
Please refer to our Privacy Policy for details on how we gather, utilize, and share your personal data. You agree to the procedures outlined in the Privacy Policy by using the Platform.
Alterations
At any time, with or without prior warning, we have the right to alter, suspend, or terminate the Platform or any portion of it. These Terms may also be changed at any moment by us. Any modifications to these Terms will be deemed accepted by you if you continue to use the Platform.
Dismissal
We have the right to immediately suspend or terminate your access to the Platform for any reason we found out as a violation. Upon termination of these Terms, you will immediately lose all credentials and rights granted to you under these Terms on the portal.
Exclusivity
YOU AGREE TO USE THIS PLATFORM ONLY FOR CONTAINER LEASE AND TRADE PURPOSES . We have clearly stated the points to follow and if anyone violates it should be responsible for his own loss.
Restrictions on Liability
To the fullest extent permitted by applicable law, the platform shall not be responsible for any data loss regarding compensatory damage or resulting damages, your profits and balances whether it’s direct or indirect.
